Professional Development Course:

TRC & Law Dialogues: First Nations Court - A View from the Bench (TRC LAW 101)

Facilitated by Judge Marion Buller Provincial Court of BC

Join Provincial Court of BC Judge Marion Buller as she discusses the role of the First Nations Court in providing support and healing to assist in rehabilitation and reducing recidivism. Learn how the FN courts are able to acknowledge and repair the harm done to victims and the community.

Nine years and a half ago, First Nations Court opened in New Westminster.  It is a sentencing court for self-identified First Nations people, referred to as clients, who plead guilty to offences over which a Provincial court judge has jurisdiction.

The court takes a holistic approach to sentencing, recognizing the inter-generational impact of residential schools.  Sentences are community-based and are called “healing plans”.  Healing plans are developed with input from the client, Court Elders and support people.

Clients are required to attend the court on a regular basis for reviews of their progress.  At the conclusion of the healing plan, the client is blanketed by the Court Elders, in recognition of the client’s achievements.

CPD: 2.0 hours including 1.0 hour in client relations, ethics and professional responsibility.
